(Claim Affirmation, Form CE-1)

(Notarization)

01 · Required documents

What the State asks for

A claim is paperwork, not magic. Knowing which documents are needed and why also tells you whether a request from anyone is normal or not.

Every document below goes to the State (the Controller's Office), not to me. I never collect a Social Security number or bank details by phone, email, or this website.

Claiming your own property

Claim Affirmation (Form CE-1)

State form

The State's own form. You can start it online, but a signed original must be mailed. The State does not accept claims by email or fax.

Copy of ID

Identity

A government-issued ID: driver's licence, passport, or state ID.

Social Security or taxpayer number

You write it on the State's form yourself

The State's claim form has a box for it. You fill that box in yourself. I never ask for it by phone, email, or this site. If someone phones asking for it, hang up.

Proof of address

Ties you to the address on file

Evidence you lived at the old address the State lists: an old bill, a lease, mail. The document people who have moved most often need.

Notarization

Some claims only

Required when cash totals $1,000 or more, and for all securities and safe-deposit-box claims. When I handle a claim, I pay the notary.

Claiming a deceased person's property

In addition to the above, you must show your relationship to the deceased and your right to claim. These documents are why estate claims take longer.

Death certificate

The deceased

Issued by the county.

Proof of heirship

Your right to claim

Documents showing you are the heir, executor, personal representative, or trustee. A probated estate needs court records.

The deceased's identifying information

For the State's verification

Such as their Social Security number, so the State can confirm whose property it is. Again, on the State's form.

Some estate claims need a lawyer. I do not represent you in court or in probate, and I do not choose, hire, pay or direct a lawyer for you. My work is to locate the property and prepare the State's claim documents. If you want a lawyer, you choose your own.

Added if you work with me

Written agreement

You read it before you sign

California law requires it to state the nature and value of the property, that the Controller holds it, and the address where you can claim it yourself for free. You must receive that disclosure before signing for the agreement to be valid. The fee cannot exceed 10%.

Property disclosure attachment

One per property

Owner name and address as reported, amount, property type, the reporting company's name and address, and the Controller's address. Six items, every property. The agreement itself needs no notarization.

If the State is still in the process of receiving the property, no agreement can be signed. That is the law, and I don't sign at that stage. The search guide shows what that screen looks like.
